With our base in southeastern North Carolina, our reach extends to every corner from Wilmington to Southport, touching the shores of Carolina Beach and reaching the heartlands of Leland. We are not just a rental service; we are a commitment to ensuring safety, restoration, and resilience in the face of flood, fire, and chemical emergencies.

Training & Damage Protocol:

  1. Training and Demonstrations: Recognizing that each piece of equipment may come with its unique set of operations, we offer brief training sessions or demonstrations to acquaint the Lessee with the optimal and safe use of our equipment. Our trained staff will guide you through the essential features and safety protocols to ensure a smooth operation.

  2. Provision of Manuals: To further aid in the understanding and safe operation of our equipment, upon finalizing the rental agreement, we will send digital copies of the relevant equipment manuals to the Lessee via email. These manuals contain detailed information on the equipment's functionality, safety measures, maintenance, and troubleshooting tips. It's imperative for the Lessee to review these manuals before operating the equipment.

  3. Reporting Damages: In the unfortunate event that the rented equipment sustains any damage during the rental period, the Lessee must notify us without delay. Prompt communication allows us to assess the situation and provide guidance on the next steps. Depending on the nature and extent of the damage, additional charges may be levied. It is crucial for the Lessee to handle the equipment with utmost care and adhere to the provided guidelines to avoid potential damages.

Maintenance and Repairs:

  1. Maintain in Good Condition: The Lessee agrees to maintain the Equipment in the same condition as at the start of the rental period, subject to reasonable wear and tear. All necessary repairs, maintenance, and care shall be performed at the Lessee's expense to ensure the Equipment remains in operational and safe condition.

  2. Proper Use: The Lessee agrees to utilize the Equipment only for its intended purpose and in accordance with the manufacturer's guidelines, recommendations, and instructions. Lessee shall not subject the Equipment to any misuse or neglect, nor shall they alter, modify, or tamper with the Equipment without the prior written consent of the Lessor.

  3. Immediate Notification: Should the Equipment malfunction, become unsafe, or require repair, the Lessee agrees to discontinue use and notify the Lessor immediately. The Lessee shall not attempt any repairs without the Lessor's prior written consent.

  4. Liability for Damage: Any damages or modifications to the Equipment, beyond normal wear and tear, will be repaired at the Lessee's expense. Should the Equipment be deemed irreparable by the Lessor, the Lessee agrees to compensate the Lessor for the full replacement value of the Equipment.

Limitation of Liability:

  1. Limitation of Liability: The Lessor shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits or revenue, loss of use of equipment, or any other associated equipment, cost of capital, cost of substitute equipment, facilities or services, downtime, or claims from the Lessee’s clients for such damages, resulting from or in connection with the use or inability to use the rented Equipment.

  2. Indemnification: The Lessee hereby agrees to indemnify, defend, and hold harmless the Lessor, its agents, officers, employees, and representatives from and against any and all claims, losses, damages, liabilities, penalties, fines, fees, judicial and administrative proceedings, lawsuits, including all legal expenses and attorney’s fees, and any other costs arising either directly or indirectly from the use, operation, possession, or renting of the Equipment provided under this Agreement, unless they result solely from the willful misconduct or gross negligence of the Lessor.

Termination:

In the event that the Lessee breaches any terms, conditions, or provisions of this Agreement, the Lessor reserves the right to immediately reclaim the Equipment without providing prior notice to the Lessee. This includes, but is not limited to, non-payment, misuse of equipment, or failure to return equipment by the agreed-upon date. The Lessor may exercise this right by entering the Lessee's premises or any other location where the Equipment is located, with or without the Lessee's consent, to repossess the Equipment. The Lessee shall be responsible for all costs and expenses, including reasonable attorney fees, incurred by the Lessor in enforcing this clause and the overall Agreement.

Compliance with Laws:

The Lessee acknowledges the importance of adhering to all statutory requirements and standards when using, transporting, and storing the rented equipment. Thus, the Lessee agrees to the following terms:

  1. Lawful Usage: The Lessee commits to operating the rented equipment strictly within the confines of local, state, and federal laws, regulations, and guidelines. This extends not only to the direct operation of the equipment but also its transportation, installation, storage, and eventual return.

  2. Awareness & Due Diligence: It is the Lessee's responsibility to stay informed about, and act in accordance with, any changes or updates in laws and regulations pertinent to the rented equipment. If unsure about any provisions, the Lessee should seek proper legal guidance or clarification before using the equipment.

  3. Liability for Violations: Any fines, penalties, legal proceedings, damages, or other consequences resulting from non-adherence to statutory requirements will be borne solely by the Lessee. Flood Water Rescue Equipment Rentals will not be held accountable for any negligence, misuse, or violation committed by the Lessee.

  4. Immediate Reporting: Should the Lessee become aware of any inadvertent violations or potential legal issues arising from the use of the rented equipment, they must notify Flood Water Rescue Equipment Rentals promptly. This ensures both parties can take proactive measures to address the situation.

The Lessee's commitment to legal compliance is not only essential for their protection but also crucial for ensuring the continued availability of essential emergency equipment for the community's benefit.

Navigating emergencies necessitates transparent and fair financial arrangements. To ensure clarity and mutual understanding, the following terms apply to the rental of equipment from Flood Water Rescue Equipment Rentals:

  1. Initial Consultation & Fee Determination: The rental fee will be mutually agreed upon during the initial consultation. Factors considered include the type of equipment, its availability, and the rental duration.
  2. Rental Fee: The Lessee commits to remitting the specified rental fee as specified in the field labeled "Rental Fee" below to the Lessor. This amount covers the usage of the equipment for the duration agreed upon and does not include potential damages or extended rental periods.
  3. Accepted Payment Methods: To facilitate a smooth transaction, we accept diverse payment modes. These include credit/debit cards, bank transfers, and checks. The Lessee is expected to ensure that payments are timely, secure, and verifiable.
  4. Security Deposit: Alongside the rental fee, a security deposit is mandatory. The Lessee commits to remitting the specified security deposit as specified in the field labeled "Security Deposit" below to the Lessor. The amount, which is determined based on the chosen equipment and the length of the rental term, acts as a guarantee against potential damages or unforeseen expenses.
  5. It is vital for the Lessee to note:
    • Refunds & Deductions: Upon the return of the equipment, this deposit will be refunded in full, provided the equipment is in its initial condition. However, if there are any damages, necessary repairs, or extended rental periods not previously agreed upon, the costs incurred will be deducted from the deposit.
    • Transparent Evaluation: All equipment will undergo a comprehensive evaluation upon return. Any concerns or potential charges will be communicated transparently, ensuring mutual understanding and agreement.

By proceeding with this rental agreement, the Lessee acknowledges their financial commitments and agrees to uphold them in good faith. This financial transparency ensures that Flood Water Rescue Equipment Rentals can continue to serve the community with high-quality equipment during times of need.
